Warranty & Seller’s Statutory Liability

Statutory protection for lack of conformity, repair, replacement, refurbished products and additional commercial warranties.

Statutory protection: The seller’s statutory liability for lack of conformity is independent of, and is not limited by, any additional commercial warranty from a manufacturer or supplier.

2. What “lack of conformity” means

A product must conform to the agreed description, type, quantity, quality, functionality, compatibility and other characteristics, be fit for normal use, and include the accessories, instructions and updates that may reasonably be expected.

For a refurbished or used product, its stated condition, specific wear disclosed before purchase, age and agreed quality grade are taken into account. A characteristic clearly disclosed and specifically accepted before the contract is not later treated as a hidden defect.

3. Duration of statutory liability

For movable goods, the buyer’s rights for lack of conformity are subject to the statutory two-year period/limitation period, without prejudice to more favourable special provisions.

For contracts concluded on or after 31 July 2026, where correction/repair is chosen as the remedy, the relevant rights for movable goods become time-barred after three years, in accordance with the applicable Greek repair-promotion framework.

4. Burden of proof

A lack of conformity appearing within one year of delivery is presumed to have existed at delivery unless this is incompatible with the nature of the product or the particular lack of conformity.

5. Consumer rights

Correction / repair

Bringing the product into conformity free of charge, within a reasonable time and without significant inconvenience.

Replacement

Replacement with a conforming product where this is not impossible or disproportionately costly compared with repair.

The consumer may in principle choose between correction and replacement. The choice may be restricted only where it is impossible or entails disproportionate costs compared with the alternative, taking account of the value, the seriousness of the issue and the ability to remedy it without significant inconvenience.

6. Price reduction or termination

The consumer may request a proportionate price reduction or terminate the sales contract where the statutory conditions are met, particularly where:

  • the remedy was not completed correctly, within a reasonable time or without significant inconvenience,
  • the lack of conformity reappears despite an attempted remedy,
  • the seller refuses or states that it will not remedy the product,
  • the lack of conformity is sufficiently serious to justify an immediate secondary remedy,
  • the lack of conformity appears within 30 days of delivery and the buyer gives notice without culpable delay.

Termination is not available for a minor lack of conformity. The seller bears the burden of proving that the lack is minor.

7. Reporting a problem

  1. Contact info@rebytelab.gr or +30 698 688 2138 with the order number, product, description of the problem and, where useful, photographs or video.
  2. ReByteLab provides inspection, drop-off or shipping instructions. Initial remote diagnosis does not limit any rights.
  3. The product is inspected and the consumer is informed of the result and the appropriate remedy.
  4. A statutory remedy is provided without charge for labour, materials, transport or any other necessary expense.

8. Sending a product for inspection

Before dispatch, remove personal accounts and data where possible, keep a backup and package the product appropriately. For products containing storage media, ReByteLab limits access to what is technically necessary.

9. Cases that are not a lack of conformity

  • a fall, breakage, moisture, fire, power surge or unsuitable electrical supply after delivery,
  • unauthorised intervention or repair that caused the problem,
  • use contrary to instructions or outside technical specifications,
  • normal expected wear of a consumable part where no initial lack of conformity existed,
  • malware, incompatible third-party software or failure to install a necessary update where full instructions were supplied and the omission is the sole cause.

The above cases do not apply generally or automatically. Each incident is assessed according to its cause, condition and the law.

10. Batteries and wearing parts

A gradual reduction in battery capacity through normal use may be normal wear. However, if performance, safety or duration differs from what was agreed or may reasonably be expected, particularly shortly after delivery, there may be a lack of conformity. Statutory protection for batteries, chargers, fans, keyboards or other parts is not excluded in advance.

11. Refurbished and used products

Refurbished and used products sold by ReByteLab are covered by the professional seller’s statutory liability. ReByteLab does not contractually reduce the statutory period below the general level of protection. Any cosmetic wear or limitations are specifically stated on the product page or sales document.

12. Commercial warranty

An additional manufacturer or supplier commercial warranty applies only where stated on the product page, accompanying document or sales document and is governed by the guarantor’s terms. It does not replace, exclude or limit ReByteLab’s statutory liability as seller.

13. Repair-work warranty

For repair services, ReByteLab is responsible for proper performance of the agreed work and for parts it supplied, in accordance with the law and the specific terms of the work. The work warranty does not cover a different, unrelated fault or a later incident not causally connected to the work.

14. Recalls and safety issues

If a product recall or serious risk is identified, ReByteLab works with the manufacturer, importer, responsible economic operator and competent authorities and provides the required corrective measures.
